If a cheque is dated 18Aug 17 and account opened on 22 August 17,we can credit cheque in his account

    Technically No, but if the amount is a paltry one (1000-3000/-) like for scholarship, rural hospital expenses, then exceptions can be made

    Depends on the purpose and the amount. Final discretion will be of the branch manager. It is usually frowned upon because the account opening is solely for encashment of the cheque

    Caution should be taken before any proceding of this type i e KYC, introduction etc. Because even technically there is not any problem but caution must.

    Bhai log kewal yes mat bolo; only yes will be lead toward to fraud so always be caution before any proceding of this type even technically there is not any problem i e 100% yes

    banking is field with diligence and logic...if u ask the customer he'll say yes i have an account in another bank but this bank is nearer to my house and hence i want to deposit here..a cheque has no condition of having an account or not.. its just a payment instrument...what will u say to the customer who has knowledge and asks for written acknowledgement of ur refusal to take te cheque??

    No..chq date must be after opening date.But as on practice bankers does do this things..juat for customers service.

    Yes everyone dont have account but anyone can get cheque before opening account. Just look kyc is correct .. can credit chq

    to all the ppl saying yes or no pls provide supporting agruments from ni act....coz as far as ni act is concerned..the collecting banker amd paying banker protection clause dont mention anything abt the date of the instrument...provided the instrument is within valid date

    It should be deposited if the AC holder's A/C KYC compliance

    There is no connections in chq ; opening dt of a/c...so yes it can crdt

    Kyuki in new account 6 month tak koi cheque k amnt ka clearing nhi hona chaiye..after 6 months u can do it

    Yes... NI act allows it as the cheque is not stale one

    No. It will be the case of money laundering. But if the cheque is from his own account of another bank then it can be credited. For further details refer to negotiable instrument act
     
  19. Mr. Ramesh is having a crossed cheque favouring in his name dated: 10.02.2015. Mr. Ramesh is not having any deposit account with any bank and such he opens an account on 12.02.2015. Whether the bank can refuse to accept the cheque since it is dated prior to the date of opening of the account?Answer:Guidelines are available in regard to acceptance of cheques and demand drafts for collection by the bankers as per Negotiable Instruments act 1881. According to the act, a cheque is valid for three months and under such circumstances, the banker has to accept the cheque till its validity – i.e. 10.05.2015.However, in practice, bankers are reluctant to accept the cheques prior to the date of opening of the account since it amounts to opening of an account exclusively for the purpose of encashing the cheque. However, the discretion of the branch manager is final in this situation and after proper analysis he permits acceptance of the cheque for collection.This can be explained as per the following two examples:A student gets a cheque for an amount of Rs. 5000/- on account of scholarship from his school or college or on account of a reward for better performance in sports, music or some other activities. He meets the branch manager, explains the situation and requests his permission for opening of an account and the branch manager permits opening of an account considering the genuineness of the issue and also accepts the cheque for collection.A company is having one overdraft account with a bank and they receive a cheque for an amount of Rs. 20.00 lakhs on account of some consideration and they approach another banker for opening an account exclusively for the purpose of collecting the cheque. In this situation, the responsibility of the branch manager is more and he has to analyse the situation in a proper manner and he should find out the reason as to why the company is reluctant to credit the cheque to the overdraft account with their bankers.The central bank has warned commercial banks to be cautious in accepting the cheques dated prior to the date of opening of account for collection in order to avoid frauds and malpractices.

    Yeah if cheque amount is in lakhs,we can comply KYC and we can verify the address and identity of the customer,if we are sure that amount is going to credit in genuine customer account,we can accept the cheques.

    With out knowing this small thing how come u all work in Bank.please be banker not typists.To be good banker in your career my suggestion is atleast study caiib.

  26. Yes ,subject to amount and customer profile,if a poor customer do not have any account in any bank and he gets any cheque from govt side.we should comply the KYC norms and accept the cheque.

  28. Yes you can but only after due diligence and checking whether account was not opened purposefully for encasing particular cheque

    WE HAVE TO CREDIT THE AMOUNT.... BECAUSE THE INSTRUMENT IS VALID TILL THREE MONTHS FROM DATE ON IT... WITHIN THAT TENURE WE CAN'T DENY REALISATION OF SUCH CHQ.

    Kar toh सकते ही है लेकिन मान लिया जाए wo cheque चोरी हो गयी है और जिसे मिला उसने fake document से खुलवाया और बोला chq credit कर दो तो क्या kar doge??See translation
